Terms of Use and End User License Agreement – Effective September 22, 2026
These Terms are a legal agreement between you and NutraEvolution Dietetics (“we”, “us”) for use of the BeHealthy4Me app (“the App”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Who can use the App
You must be at least 18 years old. You are responsible for keeping your login secure and for the accuracy of the information you provide.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the App Store or Google Play you downloaded it from.
3. Restrictions
You agree not to copy, modify, reverse engineer or resell the App or its content; use it for any unlawful purpose; upload harmful code; or interfere with how it works.
4. Health disclaimer
The App provides general nutrition, health and wellness education created by a registered dietitian. It is not medical advice, diagnosis or treatment, and using it does not create a provider-patient relationship.
Always talk with your doctor or qualified healthcare provider before changing your diet, supplements, exercise or medications, especially if you have a medical condition, are pregnant or breastfeeding, or have a history of disordered eating. Stop any activity that causes pain or discomfort and seek medical help if needed.
5. Premium subscription
- Ground Zero is free. A BeHealthy4Me Premium subscription unlocks all programs, meal plans and premium content.
- Subscriptions are available monthly or yearly at the price shown in the App before you buy.
- Payment is charged to your Apple ID or Google Play account when you confirm your purchase.
- Your subscription renews automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple ID or Google Play account settings. Deleting the App or your account does not cancel a subscription.
- If a free trial or introductory price is offered, any unused part of it ends when you buy a subscription.
- Refunds are handled by Apple or Google under their policies.
- We may change subscription prices in the future; you will be notified in advance as required by Apple and Google, and changes apply from your next renewal.
6. In-app rewards
Gems, Health Points, streak shields and similar rewards are earned in the App, have no cash value, cannot be bought, sold or transferred, and may be adjusted or reset if we change the App or find misuse.
7. Community
Your username, avatar and gem totals may appear on leaderboards. Choose a username that is not offensive and does not impersonate anyone. We may change or remove usernames or accounts that break these Terms.
8. Intellectual property
All content, programs, recipes, images, trademarks and software in the App belong to Jennifer Alvey-Dzierzynski and NutraEvolution Dietetics and are protected by law. You may not use them without written permission.
9. Privacy
Your use of the App is also covered by our Privacy Policy.
10. Termination
We may suspend or end your access if you break these Terms. You can stop using the App and delete your account at any time.
11. Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, to the fullest extent allowed by law.
12. Limitation of liability
To the fullest extent allowed by law, NutraEvolution Dietetics and Jennifer Alvey-Dzierzynski are not liable for indirect, incidental, special or consequential damages arising from your use of the App.
13. Apple-specific terms
If you downloaded the App from the Apple App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for any claims relating to the App, and is a third-party beneficiary of these Terms with the right to enforce them against you.
14. Governing law
These Terms are governed by the laws of the State of Florida.
15. Changes
We may update these Terms; the effective date above will change and continued use means you accept the update.
